Your Face Is Already Being Matched
This isn't hypothetical anymore. Federal agents ran facial recognition against protester photos during a recent immigration-enforcement operation in Minneapolis, using a stack that includes Clearview AI's database of tens of billions of scraped images, a mobile field-scanning tool built on NEC biometrics, and the FBI's own Next Generation Identification system, which draws on hundreds of millions of images pulled from DMV records, visa applications, and criminal databases alike. One woman who was simply observing an ICE operation was approached by an agent who knew her name on sight. She later found her Global Entry and TSA PreCheck quietly revoked, no explanation given. She's since joined a lawsuit over it. She wasn't the only one — several other people reported being told, flatly, that they were now logged in a "domestic terrorism database."
New York had its own version of this: NYPD investigators traced a protester at a Columbia demonstration not from a clear photo of her face, but from paint spatter on her clothing, cross-referenced against other footage. In London, police ran live facial recognition across two demonstrations in a single day in May, scanning roughly 80,000 faces against a 17,000-person watchlist — and arrested a woman on the spot for refusing to take off her face covering.
None of this is uncontested. Senators have asked ICE to suspend the practice. The ACLU has sued over the underlying technology stack. The UK's own biometrics oversight commissioner has warned publicly that the systems will misidentify people and that police departments will end up in court over it. This is a live fight, not settled law — which is exactly why it's worth knowing where you actually stand before you're in a crowd.
What Happens If Police Take Your Phone
The good news first: the Supreme Court's Riley v. California ruling means that even after your phone is physically seized, officers still need a warrant to search what's on it. They can hold the device. They generally can't read it without going to a judge first.
Getting into the phone at all is a separate question, and it splits in an important way. A memorized passcode is treated by most courts as protected testimony under the Fifth Amendment — an officer can't force or threaten you into handing it over, though a judge or grand jury can compel decryption in narrow circumstances. Biometric unlock is murkier. Because placing your finger on a sensor or looking at a camera isn't "testimony" in the same legal sense as speaking a password, some courts have ruled police can compel a fingerprint or Face ID unlock; other courts have ruled the opposite. It hasn't settled nationally, and it varies by jurisdiction. The practical takeaway: if you're relying on your phone being unreadable, a passcode gives you a stronger, more consistent legal footing than Face ID or a fingerprint. Both iOS and Android have a quick-disable for biometric unlock built in — it's worth knowing where that setting lives before you need it in a hurry.
Face coverings carry their own legal wrinkle right now. Several states — Ohio, North Carolina, Florida, and Texas among them — have recently revived decades-old anti-mask statutes, originally written in the 1940s and '50s to target the Klan, and applied them against protesters instead. Ohio's version carries a potential six to eighteen months in prison. This doesn't mean a mask is a bad idea; it means it's not a legal free pass, and the law varies enough by state that it's worth a five-minute check before you assume a face covering only helps you.
Airplane Mode Isn't What You Think It Is
Airplane mode is a request, not a guarantee. Flipping it on tells your phone's operating system to disable its cellular, Wi-Fi, Bluetooth, and GPS radios — but you're trusting the software to actually do that, every time, correctly. GPS reception is usually disabled, but apps can still read location data that was already cached before you turned it on. And if a phone has been compromised by malware, airplane mode's software switches can simply be part of what's compromised.
A Faraday enclosure works on a completely different principle: physics instead of trust. The conductive material physically blocks radio waves from reaching or leaving the device — cellular, Wi-Fi, Bluetooth, GPS, RFID, and NFC, all of it, regardless of what the phone's software thinks it's doing. A compromised phone still can't transmit through it, because there's no software layer involved to compromise. If the actual goal is "this device cannot be tracked or triggered right now," a Faraday bag gets you there in a way airplane mode doesn't quite promise.
Does Covering Your Face Actually Help?
There are two different things that get lumped together here, and they have very different track records. One is CV Dazzle — the asymmetric makeup-and-hairstyle approach developed back in 2010–2011, built on the same logic as naval dazzle camouflage, designed to break up the patterns older face-detection algorithms were looking for. It genuinely worked against some early systems. It's also, by design, extremely visible — which is the opposite of what you want if the goal is to disappear into a crowd rather than stand out in it. And it's aged: modern deep-learning face recognition is far less thrown off by the patterns that fooled a decade-old algorithm.
The other is a plain, low-tech face covering — a balaclava or neck gaiter that just physically covers the face. That doesn't need to be clever to work, because there's no face there to match in the first place. It's the more broadly reliable of the two approaches for the simple reason that it isn't trying to outsmart an algorithm — it's removing the input entirely. The same anti-mask-law caveat from above still applies, so check your state before you count on it.
A Realistic Starting Kit
Nothing here adds up to invisibility, and anyone telling you otherwise is overselling it. What you can actually do is stack a few things that each remove one specific point of failure:
Set an actual passcode rather than relying only on Face ID or a fingerprint, and know where your phone's quick-lockdown setting is before you need it. Decide ahead of time whether airplane mode's convenience is enough, or whether the moment calls for a Faraday bag's harder guarantee. A plain face covering blocks casual photo identification even where it won't fool a research-grade algorithm — just check local law first. And remember that a warrant is still required to search your phone's contents even if it's seized, which is worth knowing going in rather than figuring out after the fact.
